STANDARD TERMS AND CONDITIONS OF SALE
1. General
These Terms and Conditions of Sale (“Terms”) apply to all sales of artworks, custom artworks, and related products (“Products”) made through this website by Yllen Avotí (“Seller”) to the purchaser (“Buyer”). By placing an order, the Buyer accepts these Terms.
2. Custom Orders
Custom artworks are created individually according to the Buyer’s specifications (size, color palette, style, etc.). Minor artistic variations may occur as part of the creative process and are considered part of the artwork’s uniqueness.
3. Prices and Payment
All prices are shown in euros. Payment is due in full at the time of purchase, unless otherwise agreed in writing. Orders are not started until payment has been received.
4. Production Time
As each artwork is handmade, production time may vary depending on complexity and current workload. Estimated production times are communicated to the Buyer before or after purchase, but are not guaranteed delivery dates.
5. Shipping and Customs Duties
Artworks are shipped securely packaged using trusted couriers. Shipping times vary by destination. The Buyer is responsible for providing accurate delivery information.
International orders may be subject to import taxes, customs duties, or fees imposed by the destination country. These charges are the responsibility of the Buyer and are not included in the artwork or shipping price. The Seller is not responsible for delays caused by customs procedures.
6. Returns and Cancellations
- Standard artworks (non-custom) may be returned within 14 days of delivery, provided they are undamaged and returned in original packaging.
- Custom or made-to-order artworks cannot be returned or refunded, except in cases of damage during transit or proven defect.
- Any issue must be reported within 3 days of delivery.
7. Damage During Transit
If the Product arrives damaged, the Buyer must notify the Seller within 3 days of receipt with clear photos of the damage and packaging. The Seller will offer a replacement, repair, or refund as appropriate.
8. Artwork Care
Artworks should be displayed indoors, away from direct sunlight, excessive humidity, or heat sources. The Seller is not responsible for damage resulting from improper handling or environmental exposure.
9. Intellectual Property
All intellectual property rights in the artworks, sketches, and images remain with the Artist. The Buyer may not reproduce or use images of the artworks for commercial purposes without prior written consent.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Italy and European Union consumer protection regulations.
